Limitation of liability.
The total liability of Next Level Labs NY LLC (d/b/a Next Level Labs), together with its members, officers, employees, and affiliates (collectively, "NLL"), to you, for any claim arising out of your use of our products or this site, is limited to the purchase price of the product in question. We are not liable for indirect, consequential, incidental, or punitive damages.
This limitation applies to the maximum extent permitted by law. Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability arising from our own gross negligence or willful misconduct.
Indemnification.
You agree to indemnify, defend, and hold harmless Next Level Labs NY LLC and its members, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your purchase, storage, handling, use, or disposal of any product; (b) your administration of any product to any human or animal; (c) your breach of these terms; or (d) your violation of any law or the rights of any third party. This obligation does not apply to the extent a claim arises from NLL's own gross negligence or willful misconduct, and it survives the completion of your order.
Dispute resolution.
Any dispute arising out of these terms or your use of our products will be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in the State of New York. You waive the right to participate in class actions.
Before arbitration, both parties agree to attempt good-faith resolution by email for 30 days.
